The quick answer
Yes - the Federal Court has determined Uber driver Partners in Australia are considered to be providing ‘taxi travel’ for the purposes of GST legislation.
What else you need to know
This means that as an Uber driver Partner, you are required to be registered for and pay GST regardless of your level of income. Unlike most other businesses, the usual $75,000 GST registration threshold does not apply and you are required to account for 10% GST from the first dollar of income you earn on your Uber driver activities.

What do you need to do to comply with GST law as an Uber driver Partner?
- Apply for an ABN and register for GST from the date that you started driving with Uber.
- Keep track of your income and expenses for all business activities under the ABN (including other business income not earned from Uber).
- Report your gross income in your BAS along with eligible expenses on which you can claim the GST you paid. To understand when you can claim a GST credit refer to the ATO guidance.
- Include your Uber income in your annual income tax return.
